
Non-molestation Orders
These orders are one of the very few that HMCTS does not charge a fee for. Further, Manchester has been chosen to trial a new type of application known as Domestic Abuse Protection Orders. The applications are similar, and a discussion will need to take place to decide which is best for the Client.
The way the application is made has changed in 2024: it used to be that two forms (FL401 and FL401T) had to be completed and took a while – typically several hours. This has now been changed to an online application known as CourtNav and this has simplified matters considerably and sped up the process of getting the application into the court system. In addition, CourtNav will put the applicant in touch with local solicitors who have a Legal Aid contract to see if they can represent the client and, if that were the case, I would hand over to the solicitor and would no longer be involved with this issue.
Should the client be unable to be represented by Legal Aid, I can assist with position/witness statements and will, of course, accompany the client to any attended hearings.
Due to the nature of this application, it is common for Special Measures to be requested, such that the Client can enter the court building by a separate entrance and be escorted to the court usher by a member of the building security staff, have a private room, enter and leave the court separately to the other party and be behind a screen in court.
These Special Measures must be submitted to the court by the applicant (for each hearing) and I can help in completing the Request for Reasonable Adjustments form.
This request for special measures is not limited to Non-molestation orders and can be requested for all types of hearings.
